Right of Withdrawal
As a consumer, the customer is entitled to a statutory right of withdrawal in the case of a service booked online. Below, I inform you about the statutory right of withdrawal.

Withdrawal Instructions
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the contract was concluded. To exercise your right of withdrawal, you must inform smart gym by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract (please refer to the legal notice/imprint on the respective studio page for the addresses and/or email addresses). You may use the attached model withdrawal form for this purpose, although it is not mandatory. To comply with the withdrawal period, it is sufficient that you send the notification regarding the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheap standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

Expiry of the Right of Withdrawal

If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with regard to this contract.

The right of withdrawal expires prematurely if the fitness studio has provided the agreed services in full and only began performance after you expressly consented and at the same time confirmed that you would lose your right of withdrawal upon full performance of the contract.

In the case of contracts for an ongoing membership (e.g. use of the training areas over a fixed contract term), this does not apply merely by virtue of starting to train during the withdrawal period. In this case, the right of withdrawal remains in effect until the expiry of the statutory period.
